TÜRK MEDENİ HUKUKUNDA YAKIN KAVRAMI

Abstract

Hukukumuzda anlamına sonuç bağlanan kavramlardan biri de "ya-kın" kavramıdır. Söz konusu kavramın doğru değerlendirilmesi ve geniş-liğinin doğru belirlenmesi, yer aldığı hükümdeki sonuçların doğması açısından oldukça önemlidir. Hükmün konuluş amacı ve gerçekleşen değişiklikler ile yönelimler, yakın kavramından ne anlaşılması gerektiği konusunda bize yardımcı olmaktadır. Bu çalışmada Medeni Kanun ve Borçlar Kanun'unda geçen yakın kavramına ilişkin hükümler incelene-rek, söz konusu hükümlerdeki yakın kavramından ne anlaşılması gerek-tiği, doktrin ve yargı kararları ile değerlendirilerek belirlenmeye çalışıl-mıştır.One of the concepts meaning of which bears a consequence is the word “close person” in our law. Evaluation of this concept properly and identification of the broadness of this concept accurately is very impor-tant with regard to the results in the provision in which it is stated. The purpose of the provision, the amendments and tendencies help us to understand what is to be understood from the concept. In this study, the provisions concerning the concept “close person” in the Civil Code and the Code of Obligations have been examined and it has been tried to determine what is to be understood from the concept “close person” in these provisions by evaluating with the doctrine and judicial decisions.
