Abstract

Kat Mülkiyeti Kanunu m. 24’de bağımsız bölümlerin kullanılma şekil ve esaslarına ilişkin düzenleme yer almaktadır. Her ne kadar KMK 24 içeriğinde yer almasa da uygulamayla büro niteliğindeki bazı faaliyet-lerin mesken nitelikli bağımsız bölümlerde faaliyet gösterebileceği kabul edilmektedir. Bu uygulama gerçekleştirilirken, günümüz ihtiyaçlarının giderilmesini sağlaması, o mahkemelerce o yönde hüküm kurulması, hem yasal düzenlemenin amacına ulaşması anlamına gelir, hem de hukuken korunan menfaatler olan haklar, konu özelinde de mülkiyet hakkı, gereği gibi kullanılabilmiş ve korunabilmiş olur.Property Ownership Code art. 24, there is a regulation regarding the way and principles of using independent sections.
