CİNSİYET DEĞİŞİKLİĞİ VE EVLİLİĞE ETKİSİ

Abstract

Yaşayan bir organizmada erkekle dişiyi birbirinden ayırmaya yarayan cinsiyet, doğum ile kesinleşmiş sayılamaz. Nitekim insanın ruhsal hayatındaki değişiklikler veya başka faktörlerle hissiyatının farklılaşması mümkündür. Tıp biliminde yaşanan gelişmeler kişinin hissettiği cinsel kimliğe kavuşmasını olanaklı kılmaktadır. Hukuk düzeni de belli şartlarla cinsiyet değişikliğine izin vermektedir; ancak bu değişikliği gerçekleştirmek isteyenin evli olması birtakım sorunları beraberinde getirmektedir. Özellikle hukuken geçerli olarak doğmuş bir evliliğin eşlerden birinin cinsiyet değiştirmesi halinde akıbetinin ne olacağı doktrinde tartışma konusu olmaktadır. Bu çalışmada önce cinsiyet değişikliğinin şartlarına odaklanılmış, sonrasında böyle bir değişikliğin evliliğe olan etkisi ele alınmıştır.

Gender which makes it possible to tell apart male and female in a living organism cannot be deemed to be finalised by birth. As a matter of fact a person's feelings might become different due to changes in his/her spiritual life or other factors. The developments in medical science makes it possible for a person to attain the gender identity that he/she aspires. Legal order also allows gender-change under specific conditions; but when the person who wants to change his/her gender is married, it brings some problems with it. Especially in case one of the spouses in a legally valid marriage would change his/her gender, the consequence is still a question of debate in doctrine. This study firstly focuses on the conditions of gender change and then approaches to the impact of such change on marriage.
