TÜRK HUKUKUNDA KİRAYA VERENİN KİRALANANDAKİ AYIPLARDAN SORUMLULUĞUNA İLİŞKİN SONUÇLAR

Abstract

Bu çalışmada önce kira sözleşmelerinde kiraya verenin ayıp sorumluluğu yönünden, ayıp kavramı ve türleri ele alınmış daha sonra ise ayıptan sorumluluk çeşitli yönlerden sınıflandırılarak incelenmiştir. Belirtmek gerekir ki, ayıp halinde birden ihtimal söz konusu olup, bu ihtimallerin bazıları yasal bir takım koşullara bağlanmıştır. Kira sözleşmeleri bakımından ayıptan sorumluluğun koşulları ve buna bağlı olarak da sonuçları teorik veriler ve uygulama örnekleriyle incelenmiştir.

In this study, firstly, in terms of liability of the lessor in the lease contracts, the concept and types ofthe defect are discussed and then the responsibility ofthe defect is classified and examined in various aspects. It should be noted that in the event ofdefect, there is a possibility that some of these are subject to legal conditions. The conditions of the liability and the results of the defect in terms of the lease contracts are examined with theoretical data and application examples.
