VELAYETİN KALDIRILMASI GEREKÇESİ OLARAK ÇOCUĞUN CİNSEL İSTİSMARI

Abstract

Çocuğun gelişimi üzerinde en olumlu etkiyi yapacak ve onu dışa-rıdan gelen tehlikelere karşı en iyi koruyacak kişiler anne ve babasıdır. Bu nedenle anne ve baba çocuğun velayetine sahip olmaktadır ve çocuk üzerindeki velayetleri devam ettiği sürece özellikle çocuğun kendisini koruyamayacağı yaşlarda çocuğu korumak yükümlülükleri vardır. Ço-cuğun, anne ve/veya babanın bizzat kendisinin ya da onların bilgisi dâhi-linde başka bir kimsenin cinsel istismarına uğraması çocuğu koruyucu tedbirlerin alınmasını gerektirmektedir. Şüphesiz bu tedbirlerden en ağırı anne ve/veya babanın velayetinin kaldırılmasıdır.The ones that will have the most positive impact on the child's de-velopment and will protect the child from outside dangers in the best possible way are the child's mother and father.
