TAŞIYICI ANNELİKTE ÇOCUĞUN SOYBAĞI SORUNU

Abstract

Kişinin çocuk sahibi olma ve soyunu sürdürme hakkını kullanması her zaman doğal yollarla mümkün olmayabilir. Bu durumda yardıma yapay döllenme teknolojileri girer. Ancak çocuk sahibi olmak ve soyunu sürdürebilmek adına yapay döllenmeye hangi noktaya kadar izin verilmesi gerektiği ve bu iznin toplumsal, ahlaki ve hukuki boyutlarının iyi irdelenmesi gerekir. Bu çalışmada taşıyıcı annelik kurumunun varlığı halinde çocuğun soybağı sorununun nasıl çözümlenmesi gerektiği incelenmektedir.

It might not always be possible for a person to use his/her right to have a child and continue his/her bloodline via normal ways. When this is the case artificial insemination technologies come to assistance. But it should be probed to what extent artificial insemination should be allowed in order to have a child and continue one's bloodline and social, moral and legal aspects of this allowance should be examined carefully. This study intends to investigate how the paternity problem should be solved in case there is the issue of surrogacy.
