TÜRK MEDENİ HUKUKUNDA 1960 TARİHLİ BİR YARGITAY İÇTİHADI BİRLEŞTİRME KARARININ YOL AÇTIĞI SORUN ÜZERİNE DEĞERLENDİRMELER

Abstract

İntifa hakkı, hak sahibine söz konusu eşyayı kullanma ve semerelerinden yararlanma yetkisi tanıyan bir irtifak hakkıdır. Paylı mülkiyet ilişkisinde de, paydaşlar kendi payları üzerinde TMK m. 693/1 çerçevesinde serbestçe tasarruf edebilirler. Bunun doğal bir sonucu olarak da, pay üzerinde intifa hakkı tesis edilebilir. Paydaşlardan biri payında bir başkasına intifa hakkı tesis ettikten sonra, bunun diğer paydaşlara tebliğinden itibaren üç ay içinde diğer paydaşlar paylı mülkiyetin sona erdirilmesi için paylaşma istemezlerse, paylaşma satış yoluyla yapılacak ise, TMK 700 hükmü, oldukça isabetsiz olarak, payı intifa ile yükümlü olmayan paydaşlara çok büyük bir mağduriyet yaratmaktadır. Söz konusu hüküm, Yargıtay’ın 1960 tarihli İçtihadı Kararına dayanmaktadır. Bu çalışmada anılan hükmün arka planı olan İçtihadı Birleştirme Kararı, hüküm, yol açtığı sorun üzerinde durulacaktır.Usufruct is a right of easement, as it is known, that gives the right holder the right to use the item in question and benefit from its profit. In a shared ownership relationship, stakeholders can freely save on their own shares. As a natural result of this, usufruct right can be established on the share. After one of the stakeholders has established a usufruct right in another share, if the share is to be made by sale in order to terminate the ownership of the shareholder within three months after its notification to other stakeholders, the TMK 700 provision will be fairly incomplete, it creates a great aggrievement. In this study, the background, provision, application and proposed solution of the law will be emphasized.
