Birleşmiş Milletler çerçevesinde uyuşturucu maddelerle mücadele

Abstract

Drug trafficking which has become a global problem is trying to be taken under control with three separate United Nations Convention by international law. These contracts are primarily 1961 "TEK" Convention and 1972 Protocol amending the Convention, 1971 Convention on Psychotropic Substances, 1988 UN Convention on Combating Trafficking in Narcotic Drugs and Psychotropic Substances. In this study, the three major contracts are analysed. Firstly, the 1961 Single Convention on Narcotic Drugs and the 1972 Protocol are discussed. Under this agreement, the bodies established to supervise implementation of the contract, and the duties and powers of these organs, right of appeal to decisions of these organs, and precautions those will be taken to ensure the execution of the provisions of the contract are described. Additionally, contracting party states' obligations are expressed in detail. Secondly, the Convention on Psychotropic Substances of 1971 were examined and also the principles of the adjustments of the schedules contained in this contract, control of preparations, reports given by member states, actions of International Drug Control Board about this issue, precautions taken in order to ensure implementation of the contract by the Board and precautions taken against abuse of Psychotropic ingredients are discussed. Thirdly, the 1988 Convention Against Illicit Traffic in Narcotic Drugs and Psychotropic Convention of the United Nations are handled. Precautions for the implementation of the Convention, member states' responsibilities and duties and powers of the organs that ensure the performance of the contract are covered in this section.Sözleşmesiyle uluslararası hukuk tarafından kontrol altına alınmaya çalışılmaktadır. Bu sözleşmeler başta 1961 Tek Sözleşmesi ve bu sözleşmeyi tadil eden 1972 Protokolü, 1971 Psikotrop Maddeler Sözleşmesi, 1988 BM Uyuşturucu ve Psikotrop Maddelerin Kaçakçılığı ile Mücadele Sözleşmesidir. Bu çalışmada önce üç büyük sözleşme incelenmektedir. İlk olarak Uyuşturucu Maddeler Hakkında 1961 Tek Sözleşmesi ve 1972 Tarihli Protokol ele alınmaktadır. Bu sözleşme kapsamında sözleşmenin uygulanmasını denetlemek için kurulan organlar ve bu organların görev ve yetkileri, bu organların vermiş olduğu kararlara itiraz hakkı, organların sözleşme hükümlerini icrasını sağlamak için alacağı tedbirler anlatılmaktadır. Ayrıca sözleşmeye taraf devletlerin yükümlülükleri detaylı bir şekilde ifade edilmiştir. İkinci olarak da 1971 tarihli Psikotrop Maddeler Sözleşmesi incelenmiş, bu sözleşme ekinde bulunun cetvellerinde değişiklik yapılmasının esasları, preparasyonların kontrolü, üye devletlerce verilecek raporlar, Uyuşturucu Maddeler Milletler arası Kontrol Kurulunun bu sözleşme kapsamındaki faaliyetleri, sözleşmenin uygulanmasını sağlamak üzere Kurul tarafından alınacak tedbirler ve yine psikotrop maddelerin kötüye kullanılmasına karşı alınacak tedbirler detaylı olarak incelenmiştir. Üçüncü olarak da 1988 tarihli Uyuşturucu ve Psikotrop Maddelerin Kaçakçılığına Karşı Birleşmiş Milletler Sözleşmesi ele alınmıştır. Sözleşmenin uygulanmasına yönelik önlemler, üye devletlerin sorumlulukları, sözleşmenin uygulanmasını sağlayan organların görev ve yetkileri anlatılmaktadır.
