ORGAN VE DOKU TİCARETİ SUÇLARI (TCK. m. 91-93)

Abstract

Çalışmamızda TCK.nun 91 nci maddesinde düzenlenen organ ticareti suçları incelenmiştir. Organ ve dokunun sadece insandan elde edilmesi, ekonomik olarak değerini artırmaktadır. Eğer hukuka aykırı şekilde organ ve doku nakline müsaade edilirse, bu durum ekonomik gücü olanlar lehine bir sonuç doğurabilir. Organ ve doku alınması ve nakli mevzuatımızda müstakil bir kanun ile hukuki zemine kavuşturulmuş olup, hukuka uygun şekilde icra edilen organ ve doku nakilleri suç oluşturmamaktadır. Makalemizde, organ ve doku ticareti suçları tek tek unsurları ile birlikte incelenm tiTrading of organs and tissues crimes which are regulated in the 91th article of Criminal Code is dwelled upon in this article. Te value of the organs and tissues increases economically, due to these can only be obtained from human being. In case of the transplantation of organs and tissues is allowed unlawfully, this may lead to a conclusion in favor of who has economic strength. Transplantation and amputation of organs and tissues has been brought to a legal basis with a self contained law. Te transplantations and amputations which are performed in accordance with the law does not constitute a crime. In this article, trading of organs and tissues ofenses are discussed with their elements individually.
